A bit of legal levity plus a case of “Total Identity Theft”

I will attempt to keep it light and informative today as we have experienced such a serious few days. Our hearts, prayers and sympathies go out to all those in Newtown, CT as well as to all their friends and families everywhere. So I will begin with some levity about the legal profession…hopefully you will enjoy these brief funny stories as much as I did. Further into this post we will describe a case of “Total Identity Theft” which includes not only theft of a person’s bank account and credit cards, however to include driver’s license, social security number, medical records and the victim’s actual persona as the thief impersonated the victim for several years. As we are in the middle of the Christmas Season, it is important to note that identity theft can take at least five major different forms…not just credit card or bank accounts theft…and when it does it is called “total identity theft”. Capt. Tommie Sorrell, who led the multi agency investigation that broke up the identity theft ring centered on information pulled from the LSU Health system by then-employee Pamela Reams, said there are also victims whose information was not intercepted. She urges everyone affected by the crime to make contact.     I heard an expert on Identity Theft give a presentation today…and he asked… HOW MUCH DO YOU THINK YOUR IDENTITY IS WORTH?  To You? To Someone Else? What value would you place on your own personal identity? How would you calculate the value? Would it be in dollars? Is it one year’s earnings? two or three years earnings?  It could amount to all of your assets. Is your identity measured  in terms of emotions? Identity theft delivers a powerful negative emotional impact to the victim. Most say their lives will never be the same after it happened to them. Is it measured in terms of time? Victims say that they have been attempting to repair their identity, credit, reputation and other related personal items for years. Some victims say that they are no longer able to buy a home or car or make a major purchase as their information has been tarnished. The real impact of identity theft can be unimaginable! It would be very difficult to accept the fact that someone else is using my identity, my bank accounts, my social security number, my medical records information, my drivers license, and for someone to state to other people that they were me like attending work using my name! How would you feel about this?

    Thinking about the subject of someone stealing your identity is not pleasant…but not to think about it is even worse…It can be that it is irresponsible.  I just have seen enough people get hurt that part of my life is dedicated to helping others avoid the trauma that losing your identity can bring.     The Federal Trade Commission reported in March of 2011 that Identity Theft is the greatest consumer complaint of all and has been now for the last 12 years. In many cases we find that a criminal has filed for more than 50 different social security numbers and the owner’s tax refunds. Another example is being stopped by a police officer while driving out of state late at night. The officer looks at your Drivers License and sees that several individuals with this same drivers license number are wanted for criminal actions in many states. The officer may need to arrest you based on this conflicting data. How do you stop an arresting officer from placing you in jail when your driver’s license number has been used fraudulently by someone else. Since this is a criminal offense, you must have an attorney intervene in the arrest process in order to keep you from being jailed. Under what circumstances are you entitled to hear your Miranda Rights? Can you have an attorney to protect you in the middle of the night for cases like this?
