Small Business Owner - Legal Counsel

Legal Counsel

Today’s topic: The importance of legal counsel for a small business owner. When starting a small business, when managing a small business, when hiring key employees, when facing any state or government regulation including health care issues, when leasing space, when developing benefits, when dealing with customers and employees on sensitive issues, when one of the company vehicles is involved in a traffic accident, when dealing with tax issues, and when doing virtually anything within a small business, competent legal advice is essential for the success of the small business owner.

Many small businesses must start on a “shoestring” of available finances and may undertake personally the role of an attorney in hopes of saving money. My advice to you is to seek the services of affordable, high quality attorneys so as to avoid the high risks of legal issues down the road. If you seek out the advice of a small business development center in all likelihood they will give you the same advice. There are affordable alternatives and you can avoid the average $200 to $350 per hour cost of most business attorneys.

Prepaid Legal Services

Have an attorney at your disposal-and save on legal expenses-with prepaid legal services. Tired of skyrocketing legal fees? You do have another option-prepaid legal plans.

Prepaid legal plans have been compared to HMOs because they offer certain basic services for a monthly fee. Prices range from as little as $10 a month to $70 or more; in return, an entrepreneur gets a package of services such as, say, unlimited phone consultation with a lawyer, review of three contracts per month, up to 10 debt collections per month and discounts on other legal services. How to Hire an Attorney

Hiring a good lawyer is crucial to any successful business. Here’s everything you need to know about finding, interviewing and hiring the very best.
BY CLIFF ENNICO

There are two professionals every business will need early on: an accountant and a lawyer. The reasons for hiring an accountant are pretty obvious-you need someone to help you set up your “chart of accounts,” review your numbers periodically, and prepare all of your necessary federal, state and local tax returns. The reason for hiring a business attorney may not, however, be so apparent. A good business attorney will provide vital assistance in almost every aspect of your business, from basic zoning compliance and copyright and trademark advice to formal business incorporation and lawsuits and liability. First, some general rules about dealing with lawyers: Read more…

Now that you have these two excellent articles and information above to digest and consider, I now present you with a unique legal and consulting service solution from LegalShield and GoSmallBiz.com. Personal Success

Topic of the day:  How does a person reach a position at which they can describe themselves as having achieved personal success?

The answer to this question in my opinion is dependent on the answer that the same person gives to the question “define success”.

What may be mediocre achievement for one may be reaching the height of ambition for another. Simply said, each individual defines their own world of satisfaction and accomplishment. There is no single occupation or career that is a “fit all” for everyone. We cannot and do not want to be all doctors, lawyers, accountants, politicians, nurses and on and on. In terms of “person success” this blog post is intended for those individuals who have an entrepreneurial spirit and desire to develop their own income generating business, regardless of type. In contrast, many other posts in this Blog reach out to other interests. Just take a look at the tabs at the top of each post.

And my purpose for this post is to ask you to define success and what it means to you, select a path that you would enjoy following, and if you can gain some beneficial information to help you from this post, I welcome you. Today I will focus on opportunities for “person success” in the context of starting your own business of any type.

Blogging - Getting Started!

Blog Free!

Blogs

Blog

So you now are thinking about beginning your own blog to promote your business and are developing your blogging ideas! Great!

Blogging is a lot of fun if you like writing and creating valuable information for others. That really is what it should be about you know!

The absolute best blog sites to me are those that provide me with some useful and entertaining information that will apply somewhere in my lifestyle.

So, are you familiar with all of the blog sites available to you? How about the blog sites where you can blog free?

Do you know the most popular blog sites? Is it better to use a multi-site domain or what are the advantages of owning your own domain? pic1-Optimized

Will you be able to develop the blog site yourself or will you need assistance? How much? Please don’t underestimate this as I first did…my first three months I did on my own and learned in the fourth month that the team approach with the support of more than 1000 people with many experts is a lot more efficient and productive.

Do you intend to study copywriting to enhance your writing skills?I began in October 2012 with my first blog on Blogger.com, which is a very good free blogger site. My only concern was that I did not own the domain and that the owner of the site (Google) could make decisions which potentially could affect my investment of time and money. After studying with Ty Tribble, leading U.S. blogger, some say the #1 blogger going all the way back to 2003, and enjoying his training course MLM Blog Secrets, I opted to change my blog home to WordPress.org (WordPress.com is also a free site where you do not own your domain).   I am very pleased with that decision for many reasons. WordPress.org seems to be the most popular free site available, the only downside being  that it is built by contributors and if you need support, you need to have good, reliable access to someone who knows WordPress.org.380353_304468282896903_1155722452_ann&tywp

My purpose in writing this blog is to inform anyone considering blogging that there are many stages or phases which you graduate through to reach proficiency and productivity. It is not an overnight process however with access to an experienced team of people you can shave months off your learning and productivity curve.

I have always enjoyed writing so the study and art of blogging is highly interesting to me. Just to give you an idea of the several stages that I experienced, first was the study of attraction marketing and how to apply those techniques, copywriting, learning the value of content, how to design and format my blog to make it appealing so that others want to read it and come back again, the importance of geography and placement and design including color schemes of your blog, coming up with interesting ideas that should be appealing to your reading audience, determining who your target market really is, then finding ways to get my blog distributed, accessed and read by those that are interested. Let me just summarize today by saying that blogging is a lot of fun, it is very rewarding in many ways, it is a constant learning process, and I really wonder if you can ever reach perfection.

Now that you have somewhat of an overview of what my getting started with blogging experience has been, I want to share with the next most important step that you can take to decide if you want to get involved in blogging. It comes to me from Ann Sieg and Ty Tribble today in the form an email that includes the following message..

Law Offices

Topic of the day:

Have you ever needed to search for “Law Offices”? By search I mean online, in the phone book, ads, brochures, television commercials, by talking with your friends or family,  or any other means? If you haven’t then I hope that you never have to do so. However the likelihood that you will need an “attorney at law” at some point in time is quite likely. If you did need to make that search are you considering the several qualifications that apply for your particular need? Is there a certain field in which the attorney must be qualified? Is the attorney experienced? How do they rank among their legal peers? What will be the cost? How will they charge me? Will there be a retainer? How much? Is there a limit to what they can charge me for their services? Do they have time to work with me now on my case?  These are just some of the considerations that you may have in case you were to need an attorney at any time.

Do you think it would be better to have access to law offices with your attorneys on retainer at all times? The very wealthy typically have a staff of attorneys on retainer at all times. Can you afford to have your own staff of attorneys on retainer for an affordable cost? This  post will provide you with answers to this and many other related questions.

—————————————————————————————————————————-

Is there any confirmation that Americans need access to affordable legal services? The answer is yes…please read the following.

A research study by Research Analyst Inc.
Commissioned by LegalShield.
57 Million Americans Have Legal Issues
(That’s a whole lot of people)
The Legal Needs of American Families Study (Legal Needs Story) shows that working American and their families face a myriad of legal issues on almost a daily basis. The study shows that 57 million full-time working Americans experienced at least one significant legal event in the past 12 months, but only 60% of those who experienced such an event actually sought out the services of a lawyer to help them.

You can find affordable legal solutions at the following…

And to verify that millions have used these services and have offered their testimonials to attest to their experiences please visit the following site…
Law offices and attorneys at law are very important to access and find at all times. For those who consider that they cannot afford high quality legal representation the solutions described in this post can be very effective solutions.

Getting Started!

Get Started

How To Get Started

[color-box]Topic of the day: Many are ready to get started with their business from home and are not sure where to start. Here are some simple steps to “Getting Started”. First, decide what you are really good at and really enjoy doing.

What can you be passionate about and help others benefit in the process?Do you have a product or service idea that you think would be marketable to others? Think about why this might appeal to anyone else. How large do you think this market really is in terms of buyers? What is the competitive situation? Is the pricing very competitive?

How can you offer a unique solution or service? Is there good value to what you are going to offer to others? How will you fulfill this product or service? Are there reliable, reputable long-term companies that offer these products or services?

How can the products be marketed? Can they be marketed with direct sales person to person, via the internet, or both? What is your investment? What is the commission or compensation plan? How much sales volume will it take for you to achieve the income that you want? What are the odds that this business can be successful? What are the obstacles?

Think about the form of business that you would like to have, that is individual proprietorship, partnership, corporation, limited liability corporation or other? What are the tax implications of each based on your personal circumstances? Contact an attorney and obtain their recommendations on what you must do legally to start a business in your state as well as to the the form of business that is best for you.

Now you need to develop a business plan. Posts are available here to help you.

And now you need a marketing plan as to how you will take your products to market.

Do you agree that you will need mentoring help? What kind of help will you need?

Set up a separate bank account to monitor your expenses and your income. By your completing these steps above this gets your business up and running. Now the effort will be to implement your business plan, your lawyers recommendations, and your marketing plan.

This is how you start a business. Does this make sense to you? Is it complicated? Is it something  you can do? Is it something that you want to do? Take the steps to get started. You will be very glad that you did. [/color-box]

Today’s Topic!

As I listen to the heartbeat of America today I believe that the single greatest need in our country is for many millions of our citizens to have the opportunity to earn a good income. This includes many who are un-employed and are seeking employment, many who are under-employed and have taken employment positions which are much less than their qualifications and earning capabilities, many who have taken reductions in regular wages because employers will not pay the usual incomes due to worker competition, and many people who have had their working hours slashed from 40 hours to 32 hours or less because of new government laws and regulations that penalize employers for the number of employees that they have or the number of full-time employees.

And then there is a significant number of people in the U.S. who have learned that they can make more from government handouts…averaging $30-$45k per year…than they can earn at legitimate jobs. The current administration is aware that less than 50% of U.S. citizens pay taxes, and insists that the 50% who work for a living, pay taxes and have any assets should sacrifice to take care of those who do not work. This administration chooses to penalize those who have and give to those who do not have. Is this the right way to run America?  Our country and it’s people are in a very serious unemployment and underemployment situation and so many have stopped seeking jobs that real unemployment continues well over 10%, even though the Labor Department’s new methods of reporting have changed drastically which allows reporting to portray the economy as much improved from what it really is now.

Why am I writing about this today? It is because I am so concerned about the millions of people who currently are not taking advantage of the opportunity to live the real American dream of free enterprise. This opportunity is available for you to seize now! Our economy is being restrained in so many ways by our government and policy now that it is choking the life out of capitalism. My purposes in writing about this are the following. First I think that every citizen that feels adversely affected by this current economic environment should contact their congressional and senatorial representatives and ask them to make changes to improve our situation. Secondly, the patriotic way of the American people is to get strong and overcome any obstacles that we face…as we always have done.

And thirdly, I challenge any Americans who want better lifestyles to take action to improve their incomes and financial status in life by becoming entrepreneurs. Yes, this means starting your own business either part-time or full-time, depending upon your situation, and preparing yourself to be financially independent and free of control from the government, employers, or anyone else who is deciding your standard of living.

How to be successful!

Today’s Topic

We have discussed in several posts what elements are necessary to accomplish in the process of “how to be successful” in your small business. Let’s put these all together today in an understandable set of goals, plans, directions and implementations that hopefully will result in our ultimate goal of financial independence…that time when we have sufficient wealth that all our needs are met and we can live and perform wherever we choose…our office can be anywhere…including a nice beach in the Caribbean or on a mountaintop in the Carolina’s. I will start this by saying that giving up on achieving your goals is  not allowed…you may have to make changes in the way that you get there…but giving up is not an option.

First we began with your burning desire to achieve, your willingness to learn and a commitment to do whatever it takes to get the job done. Then we put together a business plan including our strategy of what we want to achieve, by when, how we are going to get there, and what resources we need to accomplish the job. Then we take inventory of our own resources and determine our strengths and weaknesses and decide where we will need mentors and guidance.  Essential to success are good business products or services which will be desired by the marketplace at affordable prices. Then we need an effective marketing plan to take your products to market. Now the execution of your plan, using the resources that you have along with the mentoring and guidance that you receive will lead you to the beginning of success on your plan. The level of success may be frustrating and challenging at first, however, your consistency and never give up attitude, along with analyzing, studying and improving your overall approach every day, will lead you to the level of performance that is acceptable to you.  Just remember, this is being accomplished successfully every day, many times by people much less fortunate and intelligent than you.              You are the master of your fate! Isn’t this a wonderful opportunity that we have?[/color-box]

What Is a Business Strategy?

A business strategy typically is a document that clearly articulates the direction a business will pursue and the steps it will take to achieve its goals. In a standard business plan, the businessstrategy results from goals established to support the stated mission of the business. A typicalbusiness strategy is developed in three steps: analysis, integration and implementation.

Keys To Success

Keys To Success

Topic of the day…

If you are interested in getting your business started as rapidly as possible and at the lowest cost,  then you need mentors that can share keys to success with you.  You will need key top-level mentors and a team of mentors at varying levels of expertise if you are to be successful and reduce the startup time to a minimum.  The next article by the Small Business Administration of the Federal Government estimates start-up costs of a small business at around $30,000. Frankly I don’t know many people that would even consider starting a business if it were going to cost that much. Consider getting started with  few hundred dollars or more.

How to Estimate the Cost of Starting a Business from Scratch

How much does it cost to start your own business?

Of course, the answer depends on your business model and your chosen industry. However, a useful estimate based on a 2009 study conducted by the Ewing Marion Kauffman Foundation  puts the average cost of starting a new business from scratch at just over $30,000.

Marketing and Sales

[color-box]  Marketing and Sales  Who needs the internet?
Today’s topic!
Do you need the internet? Do you need it for marketing and sales? Or maybe you just like it for entertainment?

Why does the internet seem to have a much greater appeal to many people than television? Could it be that you can get very concise, useful, correct and interesting information from the internet?

Could it be that television is designed to entertain some with what I call mediaphobia…non-mind challenging blah that the low information sector seems to consume in great volume. I remember what pablum was for children and that is a majority of the diet that the mainstream media (msnbc, abc, cbs, nbc, cnn)  feeds today to a mindless audience. This is true for many of their entertainment programs as well as for much of their biased news reporting. It is a professional disservice to the American people to choose not to provide accurate reporting on issues critical to each of us and this country. Not sure about you however I am really open to good, honest, all-American reporting as we once had. Now back to the internet.

In 1993 the internet was not even available to the public. That was only 20 years ago. If the internet is just reaching an adult age can you fathom where it will be in another 20 years…not just the internet…but digital technology…the ways we talk with each other around the world…the ways we are connected with each other…I am so pleased to talk with people around the world that I have never met…how very interesting…language barriers yes…however we have such excellent language translators now…can you imagine that you will be able to talk with anyone in the world online with immediate translation of your and their language…this is just around the corner. And we have mammoth worldwide communication developments happening around the world…if you would like to know more you can let me know you are interested…and these are mammoth and huge…if you like to get in on the ground floor of happenings to affect initially 178 countries of the world you need to tap in here with me[/color-box]

How to get rich

How Do You Get Rich?

How Do I Get Rich?

  • How to get rich

Topic of the day!

Incredibly…there are very small differences in actions between mediocrity and abundant success. Jeff Olson in his book “The Slight Edge” is generating huge attention on the subject of making decisions every day that can improve your life…and then you taking small actions on those decisions to create the improvement. This is an incredible story that I will give more attention below. The slight edge is a major support theory to what I am saying to you in this blog and posts every day.

We have talked about “The Secret” and “The Law of Attraction” which essentially states that you can achieve whatever you put your mind to accomplish.

We have “Attraction Marketing Strategies” that teach us how to attract our prospects, customers, networks and friends to us by emanating positive attraction approaches.

We have talked about how you can protect your families and businesses better in a very risky, litigious society. We have talked about how to protect your personal identity and your wealth and why that is so important.

Each of these topics or options present to us a choice of taking actions or not taking actions that could be very beneficial to us. First you need to know the information and options and secondly you need to consider your goals and your lifestyle to decide if they make sense to you.

Let me just give you an exciting example of a slight edge or difference in the way that words are used in our society. Would you believe that there are 19,950,000 more people in the world now asking the question “How Do I Get Rich” or “How Do You Get Rich” than are asking the questions “How To Get Rich” or “How Get Rich”?  If you are in any kind of business, do you think that it is important that you are aware of this phenomenon?

How do you get rich? First we need to dispel the common American Myth that you get there with a lottery ticket. On the contrary I think this blog is giving you information and options every day for you to make decisions about and to act upon. It is up to you to decide what it is that you want to change in your life to improve it significantly, whether it is losing 80 pounds, or improving the relationship with your spouse, or starting another income stream, or making your current business more successful, or protecting your family better. I suggest that this blog is presenting the basic structure and foundation of ways to show you “How Do You Get Rich”.  When you decide on your directions and begin to take action I believe it will truly enrich your lives.

The Slight Edge The Slight Edge is a way of thinking, a way of processing information that enables you to make the daily choices that will lead you to the success you desire.  The Slight Edge is “the key” that will make all the other how-to’s and self-help information that you read, watch and hear actually work.

Successful Women!

Successful Women!

[color-box]Topic of the day!Live That Dream!

About four years ago one of my fellow Christian Emmaus Brothers elected to move to another city to be with his significant other. My friend had received severe combat injuries while fighting for our country and it was time that he needed to be in a relationship that could offer a greater level of support in many ways. I had the privilege of briefly meeting his lady friend during that moving process, and at that time I introduced myself as a financial advisor working with individuals and small businesses.

This week I learned that this lady had been searching for my telephone number to contact me as she has developed a terrific dream of providing lovely quilts for nursing home patients, and her dream is to first build an internet business of quilt providers and contributors and eventually to have a storefront business for the same purpose. Her idea is really non-profit as she wants to benefit the nursing home patients with lovely quilts, benefit many talented lady quilt makers with a way to market their quilts, and to hopefully gain charitable revenues for associated christian organizations through tithes and contributions.

Her reason for seeking me out was to gain my advice on how to get started in her business. I was delighted to talk with her on the phone for over an hour where we talked over her legal needs to get her business started, her need to develop a business plan to give her business direction, and then to talk about a marketing approach using attraction marketing methods to promote her new business, which is now only about one month old.

For me this entire conversation totally confirmed my reasoning for developing this blog that you are reading now. I know that there are thousands of people that need direction in starting a new business or adjusting the direction of their current business or lifestyle in some ways that would be very helpful. This is exactly what I am working to do with this blog and posts…to provide information and tips to help individuals manage their lives, be more secure and manage their small businesses better so as to make them more prosperous.  I also know that it will take time for individuals to get to know me and trust me that I can help them in this process.  References are available on request.[/color-box]

Let’s Bring Back The American Dream!

[color-box]

American Dream

From Wikipedia, the free encyclopedia

The American Dream is a national ethos of the United States, a set of ideals in which freedom includes the opportunity for prosperity and success, and an upward social mobility achieved through hard work. In the definition of the American Dream by James Truslow Adams in 1931, “life should be better and richer and fuller for everyone, with opportunity for each according to ability or achievement” regardless of social class or circumstances of birth.[1]

The idea of the American Dream is rooted in the United States Declaration of Independence which proclaims that “all men are created equal” and that they are “endowed by their Creator with certain inalienable Rights” including “Life, Liberty and the pursuit of Happiness.[/color-box]

[color-box]Do you remember that the United States was once the land of “The American Dream”?I do and it was really true! I listened to the economics numbers today and was amazed to hear where our country has plummeted from the leadership position of leading the world in virtually all measurements. Our situation is highly disturbing and one which I call upon all Americans to express their strong concerns and wishes to all of our elected political leaders.

If you didn’t hear the numbers today…I want to share them with you…

Number of Americans eligible for work however not working last week: 90 Million
Number of Americans that stopped looking for work last week: 663,000
Number of Americans filing for employment for first time last week: 388,000
Number of Americans filing for disability last week 82,000
Number of Americans total on disability last week 8 million
Number of Americans that dropped out of the work force last week 500,000
With the reduced number of jobs and people looking for work 7.6% unemployment rate
Actual population of the United States June 2012 - 314 million
Actual unemployment rate when considering all people eligible for work 15.0%

Also Capital wealth of Americans now reduced 25%-40% during last few years

Now that we see the reality of the situation it is so important that we understand the circumstances of millions of Americans and find ways to reach out to them with jobs, opportunity, hope and encouragement. This is not intended to be a political position on anyone…it is intended to be a sober statement of realization of where our country is and what we as citizens have the responsibilities for doing. I believe that we must focus on the economic welfare of our citizens and our country and use our energies constructively to bring about change that is healthy for all Americans. I for one am very grateful that I have an opportunity to pursue financial independence for myself as well as to reach out to many others and offer to many a hand as well!
