How Much Is Your Identity Worth?

I heard an expert on Identity Theft give a presentation today…and he asked… HOW MUCH IS   YOUR IDENTITY WORTH?  To You? To Someone Else? What value would you place on your own personal identity? How would you calculate the value? Would it be in dollars? Is it one year’s earnings? Two or three years earnings?  It could amount to all of your assets. Is your identity measured  in terms of emotions? Identity theft delivers a powerful negative emotional impact to the victim. Most say their lives will never be the same after it happened to them. Is it measured in terms of time? Victims say that they have been attempting to repair their identity, credit, reputation and other related personal items for years.

Some victims say that they are no longer able to buy a home or car or make a major purchase as their information has been tarnished. The real impact of identity theft can be unimaginable! It would be very difficult to accept the fact that someone else is using my identity, my bank accounts, my social security number, my medical records information, my driver’s license, and for someone to state to other people that they were me attending work using my name! How would you feel about this? So let me ask you these questions…

Should you try to protect your identity from others using it?      Why?   Why not?  

What can happen if someone else uses your identity?  

What can you do about it?   

What will that person who stole your identity do to your life and lifestyle?

How can you protect your identity?

Thinking about the subject of someone stealing your identity is not pleasant…but not to think about it is even worse…It can be that it is irresponsible.  I just have seen enough people get hurt that part of my life is dedicated to helping others avoid the trauma that losing your identity can bring. I am a strong advocate that every citizen needs the best identity theft protection for themselves and their children. The best plan that I am aware of  provides for restoration of identity by licensed investigators. I also recommend coupling that with a family legal plan to provide the optimum in identity theft and legal plan protection.

I suggest that you need to inform yourself and your friends that there is an alternative which is much preferred by those who have been informed about the differences.  Once someone’s identity has been stolen, the preferable solution is restoration to the original status before the theft. This includes credit positions, positions with banks, drivers licenses, social security numbers, medicare records, medical records, and many agencies that have your data.

Very few people are aware that preventing identity theft is virtually impossible.  Even more do not realize what courses of action must be taken once their identity has been stolen. Very few people realize that in order to restore your identity that it will take many hours and typically years of effort to contact all of the parties that have your identity data that may have been negatively impacted. Do you know in how many digital data bases your personal identity resides? And in what locations, companies, government agencies, hospitals, employers, stores, suppliers could your data be located? Do you as an individual have access to all of these locations around the world?

This week we learned of several additional major ways that our identity can be compromised and as a result could disrupt our lives. Unfortunately there are really no ways to stop or prevent identity theft from occurring. What we can do effectively is to constantly monitor our important identification data such as Social Security numbers, Driver’s License numbers, credit card numbers, debit card numbers, bank account numbers, email passwords, medical records, invoices,  bills, and any other records that may contain our important data…and now to include digital cameras that are remote or built into computers. Constant monitoring will reveal unusual activity and then you must be proactive to correct the invasion of your data.

Here is what most people do not understand about “correcting any theft or misuse of your data”. Read this carefully!

As a private citizen you do not have access to the high security online data bases that contain your personal information! You cannot  investigate or track or evaluate that information because you do not have authorized access. The solution that I use to monitor my information and restore my identity provides licensed investigators (with offices around the world), using limited legal power of attorney to access and monitor my data, to investigate the theft of my personal identity and to restore my identity if at all possible.

Can you imagine what you would have to do in case your identity were stolen and you had to take your time and money to correct the situation? And I choose not to protect my data with an insurance policy that reimburses me for some of my  expenses of restoration as I do not have the time, the money, and data access to correct the issues. Sometimes it takes up to three years to restore a person’s identity if ever.

As the risk of Identity Theft pervades our society more and more each day, the value of having your critical data monitored constantly as well as having a team of licensed professionals to restore your identity…becomes much more important. Just consider all the ways your data can be stolen or compromised including department stores, websites, medical records, online purchases, theft of social security numbers at childbirth and many more ways.

Americans personal identity now is at greater risk than it has ever been.  As we have just experienced 40-70 million people’s personal credit card data being stolen from Target…and the Federal Government is spending millions of dollars in advertising to get Americans to use the Obamacare.gov website that professionals testify is absolutely unsecure,  the risks increase.

And since you can’t stop all this…you can only have it monitored, get notified rapidly, and then it has to be fixed taking 3 years in many cases…and some cases are never resolved….who is going to fix it for you? Do you have the time to act as an ID Theft detective and get authorization from the banks and credit bureaus and government to check on all your data? Really?  Are you serious?

Examples of Identity Theft Schemes - Fiscal Year 2013

The following examples of identity theft schemes are written from public record documents on file in the court records in the judicial district in which the cases were prosecuted.

Two Sentenced for Participating in Identity Theft Scam
On September 30, 2013, in Los Angeles, Calif., Michael Williams, of Palmdale, was sentenced to 33 months in prison and ordered to pay $787,086 in restitution. Mike Niko, of Los Angeles, was sentenced to 15 months in prison and ordered to pay $104,662 in restitution. According to court documents, from May 2008 through July 2010, Williams and Niko conspired with others to defraud the United States by using the personal identifying information of various individuals to file false tax returns claiming fraudulent tax refunds. A co-conspirator stole names and social security numbers from the California Department of Public Social Services (DPSS) computer system. The fraudulent returns claimed the First Time Home Buyer Credit and/or Earned Income Credit. Purporting to be tax preparers, Williams and Niko established bank accounts for the purpose of receiving the refunds claimed on the false tax returns.

Yesterday afternoon around five pm I received an unexpected call from one of my favorite family members! We had talked earlier this week as Thursday was her Birthday…and I wanted to wish her well and plan something for us to do this month to celebrate that wonderful event! Family is wonderful…and for me it is always fun to celebrate birthdays with them.

I knew something important was up when I received this call on a Friday afternoon…and very soon after we exchanged pleasantries she said…tell me where you got your  “legal plan”  that you pay for monthly.

My most recent post was entitled “How Important Is Protecting Your Personal Identity?” That post applies to both private individuals as well as for employees and employers of small and large businesses. In a rapid “yes” or “no” question-and-answer session during a Republican-sponsored hearing by the House of Representatives Science, Space and Technology Committee, Republican Representative Chris Collins of New York asked four experts about the security of the site:

“Do any of you think today that the site is secure?”

25% of Data Breaches Turn Into ID Theft

NEW YORK (MainStreet) — So you got an email, text or phone call from your bank or credit card provider that includes the words “data breach.”

If those words don’t make the hair on the back of your neck stand up, they should. Once you hear the term, there is a good chance the words you hear next will be “identity theft.”

So says a report from Javelin Research, which estimates that a quarter of all data breaches related to credit and debit cards lead directly to I.D. theft.

That means that of 16 million Americans warned that their credit or debit card had been compromised, about 4.4 million wound up losing money and fighting the ghosts that come part and parcel with ID theft.

That’s no mere inconvenience. Javelin says U.S consumers lost $21 billion to identity theft last year, and it cost them up to 37 hours to fix the problem.

In addition:

  • 1.26 million Americans notified of a data breach involving their Social Security numbers were victimized by identity fraud.
  • 270,000 Americans notified by a data breach on their online banking accounts saw fraudulent activity on their checking and savings accounts.
  • 324,000 Americans contacted over a data breach involving their regular checking accounts were victimized by checking and/or savings account fraud.

We are in what is called the “selling season” and if you are involved in marketing consumer services or products these next two months are critical for maximizing your marketing programs to attract the greatest number of prospects and customers possible.

There are several important action steps that you can consider to achieve and exceed your goals for 2013…as well as to begin preparing for 2014. Consider these steps…

  • Step up your marketing programs to attract prospects and customers
  • Consider special pricing and promotions whenever possible
  • Meet with your staff to discuss their ideas of how to finish strong in 2013
  • Talk with your tax professional to discuss tax-saving actions for 2013
  • Talk with your legal professionals to discuss legal questions and get advice

Small business: The Affordable Care Act, Part II

Earlier this year, I wrote a post about ways that Obamacare might help small businesses. At the time, the Supreme Court had just released it’s decision upholding most of the Affordable Care Act’s provisions and the dust was still settling on what it would all mean. Last month, President Obama won re-election, effectively removing the threat that the law would be repealed soon, and now these provisions are going into full effect, many starting in the next 12 months. Every small business person, accountant, benefits manager, and employee I have spoken with has expressed confusion, provided me questionable information, or just stared at me with a blank expression, often accompanied by a quivering lip.

The implications for small business are just beginning to come fully into focus, and these are complex but in balance are beneficial to most small businesses. The act defines a ‘small business’ as one employing fewer than 200 workers, but for this post I want to focus on the smallest of businesses – those with fewer than 25 employees and with annual revenues of under $1,000,000. This is a very specific, and huge, slice of the small business community. These businesses are almost always owner-managed, which means that they don’t have an HR person to figure it out and they may not have an accountant sophisticated enough to provide reliable answers on what the law requires.

There are a number of requirements that businesses with fewer than 25 employees need to keep in mind as we approach January of 2014 when most f the law’s provisions will have kicked in. The most important questions for these very small businesses are: 1) Am I required to provide health insurance for my employees? 2) What are my options if I do provide coverage ? and 3) When must I do something?

Entrepreneurs face a smorgasbord of risk. Have they identified a real market need? (Strategic risk.) Are they executing effectively? (Operational risk.) Will they go broke wooing customers? (Financial risk.) Will their (likely) failure tarnish their image? (reputation risk.) But there’s another risk that threatens new companies even before they’re born: legal risk.

Steven Gladstone, a lawyer at Hall Booth Smith, headquartered in Atlanta, knows about managing legal risk. Gladstone, 65, has four decades of experience forming companies and structuring private placements, often based on the value of intellectual property. He has counseled entrepreneurs in everything from film production to real estate—and he has acute appreciation for how legal snafus can sting.

Gladstone shared seven legal mistakes that new entrepreneurs tend to make, including real-world anecdotes drawn from his own practice. Bottom line, he says: If you don’t take proper precautions, your startup may be dead on arrival.

Mistake #1:  Not getting legal assistance from the beginning.

Just one example: A potential client called me a few months ago with a big problem. Six months before consulting a lawyer, he had taken a partner in a new business. Soon enough, that fellow had eaten $100,000 of my client’s money—on trips to Singapore, designer suits and other flagrant outlays. He also refused to sign a flurry of routine but important documents, and still my client continued to make funds available to him.

Painful result: a high-dollar collection matter three states away, a nasty fraud claim, a corporate dissolution, and a nightmarish settlement negotiation. What should have cost the client $3,000 to $5,000 in legal advice at inception ballooned into a tab five times that amount to untangle a big mess. And to top it off, the venture flat-lined within the next month.

Ignore what you hear and read in the news. The federal government actually reached the legal debt ceiling about four months ago. Since then, the government has been financing its monthly budget deficit by stealing/borrowing money from other government funds, like the federal government employees’ pension fund. In about two weeks, the government will run out of tricks to keep operating as if nothing has happened. If the debt ceiling is not raised by then, the government has to balance its budget.

That’s right. As much as the politicians and news media have tried to convince you that the world will end without a debt ceiling increase, it is simply not true. The federal debt ceiling sets a legal limit for how much money the federal government can borrow. In other words, it places an upper limit on the national debt. It is like the credit limit on the government’s gold card.

According to the AllClear ID 2012 Child Identity Theft Report, about one in every 40 households with young children is being affected.  Does your ID theft protection cover your children? It should as they are extreme targets especially their social security numbers. Dear Client,

It’s late March, so forgive me if I come off as a bit harsh, but do you know the old saying, “there are no stupid questions?”

That’s bull.

In fact, there are lots of stupid questions. This time of year, I hear them daily. For example:

No, you can’t deduct your hot tub as a medical expense because your “legs get sore.”

Nor can you deduct the amount paid to prostitutes as “sex therapy.”

And no, you can’t have your company make your bonus check out to your 6-year old son to avoid income taxes, though I admire your ingenuity.

As frustrating as these types of questions may be to field, however, I assure you they don’t annoy your tax advisor nearly as much as this one, which is asked all too often this time of year:

“If I do this on my tax return, what are my chances of being audited by the IRS?”

Dad joke—well it is father’s day. Decisive: How to make better choices in life and work by Chip and Dan Heath offers helpful advice for improving our ability to make decisions. It describes how we can focus on what lies in front of us and ignore many of the background factors that may, in fact, be even more important to the choices. Concerned About the Welfare of Our People and Our Country

Are you concerned about the welfare of our people and our country?

Anyone that knows me is very much aware that I love this country very much…as well as the wonderful people that populate the United States of America.

In a time when the “Military Draft” was in effect I volunteered to serve in the U.S. Army and served my two year commitment as a patriot.  My sacrifice was very minimum compared to that of many soldiers that I see returning from service…having lost several limbs and in some cases their ability to function as normal human beings for the rest of their lives.

And as I think about this tragedy then I hear about some 500,000 to 900,000 returning wounded soldiers who have had pending medical claims  for months and years which are overdue in processing by the Veterans Administration.  This gets very little media publicity and government attention towards resolution. This week the Army announced that the Walter Reed Army Hospital Warrior Cafeteria would be closed on certain hours and days which would require amputees to negotiate wheelchairs approximately 1/2 mile to receive any kind of food day or night, much less the same food as they enjoy today. Fortunately, due to public outcry the Army reversed this decision on the same day. Then we have the terrorist shooting massacre under trial classified as a workplace event. Due to this government decision, the victims are not entitled to receive hospitalization, care and other benefits they would receive if the event were classified as it really is…an event of war.  When we add the tragedy of Benghazi to this list, it seems that we have a total transformation of our military happening before our eyes. The leadership of our county have the opportunity to correct all of these mistakes.

It is for reasons of loving this country and being very concerned about the real status of at least 50-60 million people who are suffering financially, job-wise, emotionally and in many other ways now…that I feel that I must speak out and express my concerns and recommendations for improvement very clearly. I am a “conservative” politically…I believe in living according to the Constitution, with minimum government and minimum federal spending, effective and legitimate social programs, a balanced budget, and protection of our country from foreign invasion….as well as from internal invasion. Many of our countries societal principles have been destroyed for a variety of reasons and our country’s future is being gradually destroyed by many special interest groups.

We have admissions during Senate Investigations this summer that specific political organizations and individuals have been targeted by the IRS for delaying or stopping the approval of organizing 501 C4 organizations. Key members of the IRS have pleaded the 5th Amendment in order to avoid revealing the truth. At present, Congressional Hearings have learned that the top legal IRS official is part of these efforts. Investigations are on-going with much pushback from the Administration. Given these facts, and as a citizen without or with a business, do you feel more or less at risk for an audit by the IRS? If you are identified for an audit, will you represent yourself or will you have professional legal and cpa’s represent you or will you do it yourself? This information is provided to allow you to prepare for what we hope never happens to you…

Probably the most dreaded event in the financial life of a U.S. taxpayer is when the IRS notifies you that you are to be audited!
And the reasons for this event being so dreaded is the fact that you will have a very strong chance of  being in worse shape than you were before the audit in many ways…emotionally, financially, time-wise and maybe you wind up with a pay-off period lasting several years.There is very limited opportunity that you will be more pleased than you were before the audit.

It will definitely cost you time for preparation for the audit just to complete the process. You will in all likelihood experience anxiety and be very concerned about where the results of the audit will lead. You may elect to have a tax attorney or your tax preparer represent you in the process and you will need to fork over money to get this done. These professionals cost in the range of $300 per hour and running up a $15,000 bill with 50 hours of counsel is not unusual.

Then you will need to set aside the necessary time to accomplish the audit…and we both know that you could be doing other things more constructive…like growing your business instead of spending money talking about why things cost you so much. Don’t get me wrong…in some cases an IRS audit may be justified. It is just the fact that the scales are tilted totally in favor of the government and this is very intimidating.

The IRS is armed with many thousands of pages of federal tax law,  has unlimited resources to interpret the outcome of such an audit, and in many cases of governmental authority,  raise questions as to the fairness and objectivity of their actions. We currently face major concerns in this country over how the new healthcare  law will be enforced. At present, several thousand additional IRS agents are to be hired to accomplish this task. And of course this raises the issues of the Constitutional Rights to the privacy of citizens personal data. These are all very important subjects to consider.

Woman Chases Down Identity Thief - Good Morning America

When you invest a few minutes on the subject of an identity thief….which should be at the top of your priority list for you and those that you love…we can find some very interesting information. I found this incredible story recently about a young woman in San Francisco that recognized from bank videos the person in Starbucks that stole her identity…and then chased down her identity thief through the streets of San Francisco…no easy task…and called 911…asked a cab driver to stop because the woman was a thief…and the police came and arrested her…the victim showed incredible courage and determination to have this person arrested.  This brave and determined young woman victim is named Karen Lodrick…and you can begin to learn about her here…she is a heroic young woman!

Fortunately, the San Francisco media heard the story and it was reported on Good Morning America in the following film clip…

As you heard in the video, the thief received 43 days  in jail and 3 months probation…a trifling sentence for all the trauma that she put Karen through.  This is incredibly unfair to the victim…and it sends no message to the thief that if you do this you will be punished. Until we recognize the seriousness of and punish criminals for these kinds of crimes on our fellow-man, then we will only see an increase in the activity.

Karen Lodrick has proceeded to become an advocate, teacher, and speaker about Identity Theft. Her life will never be the same since that event. And she is one of the few that at least caught the perpetrator. And because of our laws…there was minimum justice.

Once someone’s identity has been stolen, the preferable solution is restoration to the original status before the theft. This includes credit positions, positions with banks, drivers licenses, social security numbers, medicare records, medical records, and many agencies that have your data. Very few people are aware that preventing identity theft is virtually impossible.  Even more do not realize what courses of action must be taken once their identity has been stolen. Very few people realize that in order to restore your identity that it will take many hours and typically years of effort to contact all of the parties that have your identity data that may have been negatively impacted. Do you know in how many digital data bases your personal identity resides? And in what locations, companies, government agencies, hospitals, employers, stores, suppliers could your data be located?

I sincerely recommend that you protect yourself for identity theft, including your children.
